Please read these Terms of Service ("Terms") carefully before using the website or services operated by SwitchPoint Services LLC ("SwitchPoint," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.
SwitchPoint Services LLC provides AI-powered business automation tools including Voice AI receptionist services, AI chatbot, SMS notifications, appointment reminders, review requests, and lead follow-up communications. Our services are provided to small businesses to automate front-office operations.
By opting in to SMS communications from SwitchPoint, you agree to the following terms governing text message services:
Opt-Out. You can cancel the SMS service at any time. Just text "STOP" to +1 (406) 224-7778. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
Help. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at the contact information on switchpointagency.com.
Carrier Liability. Carriers are not liable for delayed or undelivered messages.
Message Frequency. Message frequency varies based on the services you have opted into. Message and data rates may apply. Contact your wireless provider for details about your text plan or data plan.
Services are provided on a month-to-month subscription basis. Setup fees are one-time charges due at the time of onboarding. Monthly fees are billed on a recurring basis. You may cancel your subscription at any time before your next billing cycle; cancellation takes effect at the end of the current billing period. Setup fees are refundable within 30 days of launch under our satisfaction guarantee; after that window, setup fees are non-refundable.
You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use our services to send spam, harass individuals, or violate any applicable telecommunications regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
All content, design, and code on switchpointagency.com is the property of SwitchPoint Services LLC or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission. Client data and contacts within client CRM accounts remain the property of the respective client.
To the fullest extent permitted by law, SwitchPoint Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if advised of the possibility of such damages. Our aggregate liability for any claim shall not exceed the amounts paid by you to SwitchPoint in the three months preceding the claim.
Our services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results from AI-generated communications or automated sequences.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Orange County, Florida.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
